What a Wrongful Death Lawsuit Will and Will Not Do For You
The filing of a wrongful death lawsuit is a tough occurrence for both the plaintiff and defendant in the case. How so? Well, nobody likes being sued and the plaintiff is doing so only because someone very close to them passed away.
A wrongful death suit is pretty much what it sounds like. The plaintiff asserts that the defendant had a duty to act in a particular way, failed to do so and such failure caused the death of a person. If proven by the plaintiff, these cases tend to end up with very large jury verdicts because the nature of the damages associated with losing a loved one are understandably large. After all, how do you value a life?
So, what will a wrongful death lawsuit do for you should you win? Well, let's be brutally honest. Many victorious parties will gain a sense of vengeance against those responsible. It may not be polite to talk about, but it will occur. On a more practical level, the plaintiff should gain a significant financial award. This can be used to pay off a home mortgage, medical bills and set up the survivors of the deceased for the future. That being said, the award should not be viewed as akin to winning the lottery, to wit, buying high end cars and so on is going to be a huge mistake.
What will a wrongful death lawsuit not do for you? We are social creatures. Finding that special person is one of the goals we all have in our life. Filing a wrongful death lawsuit is not going to bring that lost loved one back to you. Winning a huge monetary award will be nice, but it is hard to laugh, cry and hug money. That doesn't mean you shouldn't file suit, but money is only a form of paper with some value. People are much more than that.
The purpose of this article is not to suggest that filing a wrongful death action isn't worth your effort. To the contrary, I believe those responsible should always pay and pay a lot. Instead, the point of this article is simply to make sure you understand that there are many aspects to losing a loved one ' financial, emotional, social ' and a lawsuit will not help with all of them.
